Read the following very carefully.

 

1. Set Up your Shot Online League Account.

A.You may establish only one (1) Account with which to compete in the League Contest for access tothe Service in accordance with the terms, conditions and limitations contained in the Terms ofService. To establish an Account, you must be a “natural person “who is over sixteen (16) years of ageor the age of majority in your place of residence. Corporations, limited liability companies,partnerships, or any form of legal entity other than a “natural person” may not establish an Account.By accepting this Agreement, you represent and warrant that you are a “natural person” over the ageof sixteen. You may not share your account with others. You are liable for all activities you conductthrough your account.

B.In order to register an Account to use League Competition, you must provide Shot online Leaguewith your player name in proper form (as used in the Shot Online game) and your email address.Failure to provide the foregoing information, or failure to update the foregoing information whenyour contact information changes, constitutes a breach of this Agreement that may result inimmediate termination of your right to use your Account to access the Service. This information willbe used to identify you as a “unique user”. In the event that Shot Online League learns that you haveprovided Shot Online League with false or misleading registration information, Shot Online Leaguereserves the right to terminate your account immediately without notice.

C.During the registration process, you will be required to provide an email address, password, andyour (exact spelling as used in the Shot Online game) player name specific to your account(collectively, the “Password”). Your Password must be kept confidential at all times and you aresolely responsible for the security of your Password and your Account. You may not disclose yourPassword to any third party or allow your Password to be used by any third party to use Shot OnlineLeague. You are solely responsible for any and all damages to your account or Shot Online Leagueresulting from lost or deleted characters or lost or deleted items within the account due to thedisclosure of your password or the discovery of your password by a third party. Note that your playername (username) is subject to the naming guidelines contained in the Terms of Use.

 

2. Restrictions on the Use of Shot Online League.

Your license to use Shot Online League is limited by a number of factors, which are listed here and are included in the Shot Online League Agreement that you were required to accept when you registered on Shot Online League website. The restrictions on your right to use Shot Online League include, but are not limited to, the following:

A.Shot Online League expressly reserves the exclusive right to create derivative works from ShotOnline League. This means that you may not create any works based on Shot Online League withoutShot Online League’s prior express written permission.

B.Only Shot Online League or its licensees have the right to host Shot Online Leagues (LeaguePortal). Accordingly, you may not host, provide matchmaking services for, or emulate or redirect anyof the communication protocols used by Shot Online League as part of Shot Online League,regardless of the method used to do so. Prohibited methods include, but are not limited to, protocolemulation, tunneling, reverse engineering, modifying Shot Online League, Leagues, addingcomponents to Shot Online Leagues, or using a utility to host Shot Online League.

1. You may not modify Shot Online League to alter gameplay, including but not limited to creating cheats and/or hacks, and you may not use any third-party software that runs concurrently with Shot Online League’s games and accesses files that are part of Shot Online League and Shot Online for any reason. In addition, you may not use “packet sniffing” software, regardless of the operating system such software uses and regardless of whether such tools are running on the same computer as The League or a computer connected to this League Portal or its network, or otherwise monitor Shot Online League’s network connection while you or anyone else is using Shot Online League.
2. You may not conduct an attack on a Shot Online League server or otherwise intentionally attempt to disrupt the Shot Online League servers. You may not conduct any attack that causes disruption to the Leagues.

ANY ATTEMPT BY YOU OR ANY OTHER PLAYER WITH AN ACCOUNT ATTRIBUTABLE TO YOU TO INTENTIONALLY DAMAGE SHOT ONLINE LEAGUE OR TO UNDERMINE THE LEGITIMATE OPERATION OF SHOT ONLINE LEAGUE IS A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND SHOULD SUCH AN ATTEMPT BE MADE OR ASSISTANCE BE GIVEN TO SUCH AN ATTACK, SHOT ONLINE LEAGUE RESERVES THE RIGHT TO SEEK DAMAGES FROM SUCH USER TO THE FULLEST EXTENT PERMITTED BY LAW.

1. You shall not intentionally or unintentionally violate any applicable local, state, national or international law or regulation.
2. You may not modify any file that Shot Online League has not expressly authorized you to modify.
3. You may not remove, alter or conceal any proprietary notices or labels on Shot Online League without Shot Online League’s prior written consent.

 

3. Shot Online League Rules of Conduct.

As with all things, Shot Online League has certain rules of conduct that must be followed by all users of Shot Online League. It is your responsibility to know, understand and abide by these rules of conduct. The following rules are not intended to be exhaustive, and Shot Online League reserves the right to determine what conduct violates the spirit of the League and to take such disciplinary action as it deems appropriate. Shot Online League reserves the right to add to or modify this list of rules at any time, and you are responsible for reviewing these Terms of Use each time you log in for any newly modified or posted rules.

A. Rules regarding usernames. Every user is obliged to choose his player name from the Shot Online game for his account. If you register an account that can be seen by other members on Shot Online League, you must abide by the rules of common decency. If Shot Online League, in its sole discretion, finds such name offensive, Shot Online League reserves the right to change the name, remove the name, and/or block your use of Shot Online League. Specifically, you may not use:

(1) Name of another person with intent to impersonate;

(2) Names that contain profanity or profane words, or are otherwise offensive, defamatory, vulgar, obscene, hateful, or racially, ethnically, or otherwise objectionable. This also applies to names based on sexual innuendo or connotations (e.g. Vibrator, SexToy, Dildo, etc.);

(3) Names subject to the rights of another person without permission;

(4) Names that are intentionally used to impersonate Shot Online staff. For example: Shot Online League should not be included in the account name, nor should SOL or LeagueMaster.

(5) Names of religious figures (e.g., Buddha, Jesus, Satan);

(6) Names of notorious personalities and organizations (e.g., Hitler, Nazis, Al Qaeda);

(7) Names associated with drugs, narcotics, or criminal activity, including references to drug substances (e.g., heroin, cocaine, cannabis);

(8) Names that do not fall under the above 6 areas but may result in inappropriate comments, chats, or other forms of in-game communication.

In addition, you may not intentionally use a misspelling or alternate spelling to circumvent the above naming restrictions, nor may you have a “before” and “after” name that, when combined, violate the above naming restrictions. Shot Online League reserves the right to final name approval or exceptions to this naming policy.

B. Rules regarding “chat” and interaction with other users. Communication with other users and Shot Online League representatives is an essential part of Shot Online Leagues and is referred to in this document as “chat”. Your chats may be reviewed, modified and deleted by Shot Online League without notice. Shot Online League is under no obligation to monitor the chat, and you participate in the chat at your own risk. When you chat on Shot Online League, you may not:

(1) transmit or post any sexually explicit images or other content that Shot Online League, in its sole discretion, deems objectionable; nor may you transmit any unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, hateful or racially, ethnically or otherwise objectionable content;

(2) Take actions that are disruptive;

(3) disrupt the normal flow of dialogue in the chat or otherwise behave in a manner that negatively affects other users, individuals or organizations, including but not limited to posting “spam” messages on Shot Online League (“spam” messages, as used herein, include but are not limited to any attempt to use a computer or other electronic device to post an unauthorized and/or unsolicited advertisement on Shot Online League);

(4) “Spam” by posting or sending more than one unsolicited message or mail to a single address or in a chat area;

(5) communicate or post a user’s personal information on or to Shot Online League or any website or forum associated with Shot Online League;

(6) Use bots or other automated techniques to collect information or submit or post personal information from users on or to Shot Online League or forums associated with Shot Online League;

(7) Harass, threaten, stalk, embarrass or cause distress, unwanted attention or discomfort to another Shot Online League user or any other person or entity;

C. Rules related to league play. Leagues is what Shot Online League is all about. Accordingly, the rules that govern League play on Shot Online League are taken very seriously by Shot Online League. Note that Shot Online League considers all valid play in Shot Online League to be part of the game.

(1) All League Rules can be found here (League Rules), and are to be followed by all players exactly, in case of violation of the League Rules this can lead to exclusion from the Leagues, Shot Online League reserves the right to exclude League players.

(2) You may not exploit design flaws, undocumented features, and/or “program bugs” to gain access that is not otherwise available or to gain a competitive advantage over other players.

(3) You may not use any tools that hack or modify the Shot Online League portal.

(4) You may not use software products that enable “packet sniffing” or scripting and/or macroing to obtain information from Shot Online Leagues to gain a competitive advantage over other players.

(5) You may not do anything that Shot Online League believes is contrary to the “essence” of Shot Online League.

 

4. Account/Password Security.

You are responsible for maintaining the confidentiality of your password, and you are responsible for all uses of your password, whether or not authorized by you. Please also note that the security of your account is your responsibility. Shot Online League is not responsible in the event that your account is “hacked,” or if your account or computer is damaged by a virus, or for any other problems with your computer or account that may occur in connection with your use of Shot Online League. If you believe that your account has been compromised, please contact Shot Online League technical support by sending an email to the Shot Online League technical support email address, and the Shot Online League team will make every effort to assist you in restoring the security of your account. This includes assistance with resetting passwords, help offering basic suggestions to improve the security of your account. If you report your account as stolen, hacked, or otherwise compromised, Shot Online League will suspend the account while we fully investigate the matter. This is to protect the items belonging to the account. Following this investigation, Shot Online League will determine the appropriate course of action.

 

5. Consequences of Violations of the Shot Online League Code of Conduct.

Shot Online League reserves the right, in its sole discretion, to take any action it deems necessary to preserve the integrity of Shot Online League and the Service. Violation of any of the above terms may result in Shot Online League taking action, effective immediately or at a time determined by Shot Online League, which may include, but is not limited to:

1. Shot Online League may temporarily suspend your access to the Service,
2. Shot Online League may permanently block your access to the Service; and/or
3. in the event that Shot Online League is contacted by government authorities and/or parties seeking information or remedies against you for any violation committed or alleged to have been committed by you in connection with your use of Shot Online League, Shot Online League will fully cooperate with all government authorities and any lawful court order relating to the release of information pertaining to you and your use of Shot Online League, including, but not limited to, user Internet Protocol (IP) addresses, related personally identifiable information and any other stored

user information. Without limiting the foregoing, Shot Online League reserves the right to refuse service to any user who violates the Shot Online League Terms of Use or the Shot Online League Agreement.

 

6. Changes to the Terms of this User Agreement.

Shot Online League reserves the right, at its sole discretion, to change, modify, add, or delete any of the terms and conditions of this Agreement at any time, including, without limitation, the access policies, Shot Online League availability, hours of availability, content, data, or equipment required to access Shot Online League. Shot Online League will post notice of any such changes on the Shot Online League website and will post the amended Terms of Use at that location. Shot Online League may also, at its sole discretion, provide notice of the changes by other means, such as email, postal mail, or pop-up screen. If any future changes to this Agreement are unacceptable to you or cause you to no longer comply with this Agreement, you may discontinue use of your Shot Online League account and terminate the account. Continued use of Shot Online League by you after notice of any changes to this Agreement will mean that you accept all such changes. Shot Online League may change, modify, suspend or discontinue any aspect of Shot Online League at any time. Shot Online League may also impose limits on certain features or restrict your access to parts or all of Shot Online League without notice or liability. You have no financial or other interest in any features, content, or availability of Shot Online League, Account Data (as defined below), or the terms of access to or use of Shot Online League.

 

7. Property.

All title, ownership rights and intellectual property rights in and to Shot Online League(including but not limited to user accounts, titles, computer code, themes, objects, character names, stories, dialogue, catch phrases, locations, concepts, artwork, animations, sounds, musical compositions, audiovisual effects, methods of operation, moral rights, all related documentation, “applets” incorporated into Shot Online League, transcripts of chat rooms, member profile information, records of leagues played on Shot Online League) are the property of Shot Online League or its licensors. Shot Online League is protected by European and United States copyright laws, international copyright treaties and conventions, and other laws. All rights are reserved. Shot Online League may include certain licensed materials, and Shot Online League’s licensors may protect their rights in the event of a breach of this Agreement.

 

8. Termination.

This Agreement is effective until terminated by either party. If you terminate this Agreement, you will lose your right to your Account and related benefits. Shot Online League reserves the right to terminate this Agreement without notice if, in Shot Online League’s sole discretion, you breach any provision of these Terms of Use. Please note that Shot Online League will cooperate fully with any criminal investigation, including, but not limited to, tracing users’ Internet Protocol IP addresses and related personal information, and disclosing any other user information to the appropriate authorities upon request.

 

9. Acknowledgements.

You hereby acknowledge that:

1. You will pay for Internet access, telephone charges, and any equipment, maintenance, repairs or corrections necessary to connect to Shot Online League;
2. As part of your registration process and in exchange for the privilege of accessing Shot Online League, Shot online League has the right to send your computer one or more “cookies” without notice to you, and Shot Online League has the right to obtain certain information about your computer and its operating system, including central processing unit, IP addresses, and operating systems, for identification purposes without notice to you;
3. Shot Online League has the right to obtain “non-personal” information from your connection to Shot online League in order to make certain demographic assumptions about Shot Online League users without notice to you;
4. Shot Online League is provided “as is” and Shot Online League does not warrant that Shot Online League will be uninterrupted or error-free, that defects will be corrected, or that this site and/or the Service or the server are free of viruses or other harmful components, and Shot Online League expressly disclaims all warranties, express or implied, with respect to Shot Online League, including, without limitation, any warranties of condition, defects, use, merchantability or fitness for a particular purpose or use, and non-infringement. Any warranty against infringement provided by Section 2-312(3) of the Uniform Commercial Code and/or any other comparable state law is expressly disclaimed. Some states do not allow the exclusion or limitation of implied warranties or liability for incidental damages, so the above limitations may not apply to you.
5. NEITHER SHOT ONLINE LEAGUE NOR ITS PARENTS, SUBSIDIARIES, LICENSORS OR PARTNERS (collectively, “LICENSORS”) SHALL BE LIABLE IN ANY WAY FOR ANY LOSS OR DAMAGE OF ANY KIND, ARISING OUT OF THE USE OF SHOT ONLINE LEAGUE, INCLUDING, BUT NOT LIMITED TO, LOST GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR MALFUNCTION, OR ANY OTHER DAMAGES OR LOSSES. FURTHER, LICENSOR SHALL NOT BE LIABLE IN ANY WAY FOR LOSS OR DAMAGE TO PLAYER ACCOUNTS, ACCOUNT, STATISTICS OR USER PROFILE INFORMATION STORED BY SHOT ONLINE LEAGUE. LICENSOR ASSUMES NO RESPONSIBILITY FOR ANY INTERRUPTIONS TO THE SERVICE, INCLUDING BUT NOT LIMITED TO ISP MALFUNCTIONS, SOFTWARE OR HARDWARE FAILURES, OR OTHER EVENTS THAT MAY RESULT IN LOSS OF DATA OR INTERRUPTION OF SERVICE. IN NO EVENT WILL LICENSOR BE LIABLE TO YOU FOR INCIDENTAL, SPECIAL, EXEMPLARY OR CONSEQUENTIAL DAMAGES. Some states do not allow the exclusion or limitation of incidental or consequential damages, or the limitation of the duration of an implied warranty, so the above limitations may not apply to you;
6. You may not be able to access Shot Online League at all times, and there may be extended periods of time when you cannot access Shot Online League;
7. Shot Online League shall not be liable for any delay or failure to perform due to causes beyond Shot Online League’s reasonable control;
8. Shot Online League requires the creation and retention of electronic files, including but not limited to player accounts, accounts, statistics, user profiles, etc. (“Game Data”) that are stored by Shot Online League. Shot Online League places great importance on the security of Account Data and assumes no liability for the loss of Account Data for any reason whatsoever, including but not limited to server failures, telephone or network interruptions of any kind, defects, viruses or other harmful components, or negligent acts of Shot Online League and/or its affiliates;
9. Shot Online League reserves the right, at its sole discretion, to modify or delete any information, including but not limited to account data and any other information collected, stored or uploaded on Shot Online League;
10. You are fully responsible for all activities that occur through your Shot Online League Account. In the event that you become aware of any known or suspected breach of security, including loss, theft or unauthorized disclosure of your account and password, you will immediately notify Shot Online League via the Support E-Mail Address (support@shotonline-league.com) to promptly report the suspected breach of security with respect to your Shot Online League Account;
11. Shot Online League will not be liable for any circumstances arising from the unauthorized use of the User’s password or Shot Online League Account. Any fraudulent, abusive or otherwise illegal activity in connection with your Shot Online League Account may be reported by Shot Online League to the appropriate law enforcement authorities. The terms of this Agreement apply to all persons using your Shot Online League Account, and you are personally responsible and liable for the consequences that may result if such person violates the terms of this Agreement, including but not limited to termination and loss of your Account.

 

10. Equitable Remedies.

In the event that you breach this Agreement, you hereby agree that Shot Online League would be irreparably harmed if this Agreement were not expressly enforced, and you therefore agree that Shot Online League shall be entitled to equitable remedies with respect to breaches of this Agreement, without bond, other security, or proof of damages, in addition to any other remedies available to Shot Online League under applicable law. If either party initiates litigation in connection with this Agreement, the party prevailing in such litigation shall be entitled to recover from the other party all costs, attorneys’ fees and other expenses incurred by the prevailing party in the litigation.

 

11. Miscellaneous

The Terms of Use, Rules of Conduct and League Rules (“Agreements”) are subject to change at any time without prior notice to the user. Although Shot Online League takes certain steps to notify our users of changes, it is the user’s sole responsibility to review the Agreements periodically for changes. Changes to the Agreement will only affect Shot Online League after the stated effective date of the amended Agreements are posted. Shot Online League does not provide telephone support.

Log Files

Like most Internet services, we may use log files on the server side.
